HH&M is one of the leading commercial litigation firms in the country and has a fully fledged commercial litigation department consisting of 4 partners and 6 associates. HH&M has been involved in several complex litigation and arbitration matters. Indeed, it is the lead litigation adviser to several large local and multinational companies in Kenya in relation to complex commercial agreements disputes, labour law, debt collection, public procurement appeals, arbitration, and carriage by air and aviation matters.
We have been continuously giving advice to the Kenya Bankers Association and to several banks in respect of proposed amendments to the Banking Act and to the Central Bank of Kenya Act, which may affect the banking industry in Kenya significantly.
The partners in the litigation department have been involved in complex commercial litigation for diverse clients including insurance companies, banks, oil companies, preshipment inspection companies etc. This includes a complex telecommunications arbitration between Kencell Communications Limited (now known as Celtel) and Telkom Kenya Limited. This was the first of its kind in this part of the world and required experts to be brought out from the United Kingdom and France.
The department also has tremendous depth in matters of insolvency, winding up of companies and bankruptcies.
Kiragu Kimani and George Gitonga Murugara have also appeared on quite a number of occasions before the Public Procurement Complaints, Review and Appeals Board on applications for administrative review under the Exchequer and Audit (Public Procurement), Regulations, 2001 for clients.
